Liability Waiver and Business Policies
The training, programs, and events held by Sculpt Pilates may put you at risk for accidents, injury, illness, or even death. There are risks inherent in any physical activity, including but not limited to falls and injuries sustained as a result of contact with other participants, equipment, or employees/agents of Sculpt Pilates. Sculpt Pilates will not assume responsibility for such risks.
It is your responsibility to communicate any physical or psychological concerns that may prevent you from taking part in an activity. You confirm that you are physically and mentally able to perform every chosen activity. At any time, you are free to communicate with instructors, employees or independent contactors for Sculpt Pilates any concerns you have with performing the exercises suggested.
As you have read this waiver and acknowledge these facts, in exchange for the services that Sculpt Pilates will provide you during your participation, you agree to waive any responsibility or liability from Sculpt Pilates, its officers, employees, agents, representatives, instructors, landlords, and attorneys. This Waiver shall equally apply to anyone entitled to act on your behalf arising out of your involvement in the training programs and/or events at Sculpt Pilates.
Through this Waiver of Liability and Assumption of Risk document, you also agree to indemnify and hold harmless Sculpt Pilates, its officers, employees, agents, representatives, instructors, landlord, and attorneys. This indemnification and hold harmless includes your obligation to pay reasonable attorney fees.
You confirm that you have read and understood this Waiver of Liability and Assumption of Risk form. You are aware that by agreeing to its terms; you waive any and all legal claims which might arise from your participation.

In the event that under the law, your information is required to be turned over to a third- party, Sculpt Pilates will not release your information until the appropriate documentation is received.
Client lists are considered assets of a business. Accordingly, if we merge with another entity or if we sell our assets to another entity, our client list and information, including personally identifiable information you have provided us, would be included among the assets that would be transferred.
PHOTO RELEASE FORM
From time to time, Sculpt Pilates may take photographs or record video of individuals and/or classes. Sculpt Pilates may use your likeness in a photograph, video, or other digital media (“photo”) taken at Sculpt Pilates or a Sculpt Pilates affiliated event in any of its publications, including web-based publications.
You understand and agree that all photos will become the property of Sculpt Pilates and will not be returned and you expressly waive any compensation for the use of the photo.
You authorize Sculpt Pilates to edit, alter, copy, exhibit, publish or distribute these photos for any lawful purpose. In addition, you waive any right to inspect or approve the finished product where my likeness appears; and any right to royalties or other compensation arising or related to the use of the photo.
YOU HAVE READ AND UNDERSTAND THE PHOTO RELEASE. YOU ARE AT LEAST 18 YEARS OF AGE, AND YOU UNDERSTAND THAT THIS PERMISSION BINDS YOUR HEIRS AND ESTATE.
Cancellation Policies
A $12 late cancellation fee will be applied to your account in the event that the client cancels a class within 12 hours of class time. For no-shows a $23 fee will be applied to your account. For class pack clients one credit will be deducted from your account.
Purchase Policies
All classes are prepaid prior to schedule.
